1. Acceptance of Terms

By accessing or using TrueSight at truesight.waddleware.eu (the "Service"), creating an account, or purchasing a subscription, you ("User") agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must not use the Service.

2. Description of Service

TrueSight is a commercial web-based application that allows users to design professional CCTV coverage plans. Features include:

• Placing cameras on exterior maps or uploaded interior floor plans.
• Visualizing camera coverage using dynamic field-of-view cones, infrared ranges, and PTZ behavior.
• Adding walls, fences, and polygonal obstacles that realistically occlude camera views.
• Designing wiring between cameras and infrastructure (NVRs, power outlets) with automatic length and cost estimation.
• Cloud-based project storage, organization-wide collaboration, and external read-only sharing.

The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. User Accounts & Organizations

3.1 Registration

To access premium features, save projects, or collaborate, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at security@waddleware.eu of any unauthorized use of your account.

3.3 Age Requirement

You must be at least 16 years of age to create an account and use the paid features of the Service, in compliance with EU GDPR requirements for digital consent. Users under 16 may use the Service only under parental or guardian supervision.

3.4 Account Deletion

You may delete your account at any time via the Account Dashboard. Upon deletion, your personal data and projects will be permanently removed from our systems. Any unused subscription time remaining at the time of deletion is non-refundable unless required by applicable law.

4. Subscriptions & Payments

4.1 Pricing Tiers

TrueSight offers Free, Pro, Team, and Enterprise subscription tiers. Prices are displayed in Euros (EUR) and are inclusive of any applicable VAT where required. Prices are subject to change at our discretion, but changes will not affect active subscription periods already paid for.

4.2 Payment Processing

All payments are processed securely via Stripe, a third-party payment processor. WaddleWare does not store any credit card or payment information on its servers. By making a purchase, you agree to Stripe's Terms of Service and Privacy Policy.

4.3 Billing & Renewal

Subscriptions are billed in advance on a recurring basis (monthly or annually). Your subscription will automatically renew at the end of each period unless cancelled. You may cancel your subscription at any time via your account settings or Stripe customer portal.

4.4 Refund Policy

Subscription payments and one‑time add‑on purchases (including but not limited to the Single Project Premium) are generally non-refundable once a transaction is completed. If you believe you were charged in error, please contact us within 14 days of the transaction. Refunds are granted at our sole discretion and may be required under applicable EU consumer law.

5. User Content & Acceptable Use

5.1 Your Content

Project data, floor plans, and configurations you upload to TrueSight remain your property. We do not claim ownership of your content. By using the Service, you grant WaddleWare a limited, non-exclusive licence to store and process your data solely for the purpose of providing the Service.

5.2 Acceptable Use

You agree not to use the Service to:

• Plan or facilitate illegal surveillance, stalking, or any activity that violates privacy laws or human rights.
• Violate any applicable local, national, or international law or regulation.
• Infringe upon the intellectual property rights of others (e.g., uploading floor plans you do not have the right to use).
• Attempt to reverse-engineer, scrape, or abuse the API or underlying infrastructure.
• Resell or redistribute the Service without express written consent.

6. Limitation of Liability & Disclaimer of Warranties

Important — please read carefully. This section significantly affects your legal rights.

6.1 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WaddleWare does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

6.2 Data Loss

WaddleWare expressly disclaims any liability for the loss of user data, including saved projects, floor plan images, and account information. While we implement reasonable measures to protect your data (including SQLite backups and optimistic locking), we strongly recommend that you export and locally back up any important project data using the built-in JSON export feature.

6.3 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WaddleWare, ITS OPERATORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

WaddleWare's total aggregate liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to WaddleWare in the twelve (12) months preceding the claim, or €50.00, whichever is greater.

7. Intellectual Property

TrueSight CCTV Planner is a proprietary commercial software application. All rights reserved. The software, its source code, design, and associated documentation are protected by copyright and intellectual property laws. Unauthorized copying, distribution, or modification is strictly prohibited. Please refer to your End User License Agreement (EULA) for detailed terms.

8. Termination

WaddleWare reserves the right to suspend or terminate your account at any time, without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or abused the Service. In case of termination for cause, no refund of subscription fees will be provided.

9. Changes to These Terms

We reserve the right to update or modify these Terms at any time. If we make material changes, we will notify you by updating the "Last Updated" date at the top of this document and, where practicable, by displaying a notice within the application or sending an email to your registered address. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

10. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Slovak Republic, without regard to its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in the Slovak Republic. If you are a consumer in the EU, you may also submit a complaint to your national consumer protection authority or use the EU Online Dispute Resolution platform at ec.europa.eu/odr.
